The trial court found, among other things, that the testatrix lacked
testamentary capacity. On appeal, the court was distressed that the
record was incomplete. A presumption exists that the missing portion of
the record supports the factual determinations made by the fact-finder
and thus all fact-based contentions of error failed.
Moral: When appealing a decision of the trial court, be certain to
supply the appellate court with a complete record.
