The Supreme Court of the United States in an
unanimous opinion held that funds contained in an inherited IRA are not
exempt from the owner’s bankruptcy estate. These
funds are not the “retirement funds” of the new owner but are instead
part of the owner’s general assets.
Moral: A person who inherits an IRA may
need to take steps to protect those funds from creditor attack.
